I.             Our approach to respecting your privacy

We understand that your trust in us, is PETCORE EUROPE’S most important asset (hereinafter referred to as "PETCORE EUROPE", "we" or "us"). As such, your privacy is essential for us. We greatly respect your privacy and we are committed to protecting it through compliance with this privacy statement We commit ourselves to be transparent with you by providing clear information about what personal data we collect; what we do with it and why; who we disclose it to; how we protect personal data and what choices you have regarding the use of your personal data by us and third parties by means of this privacy statement.

PETCORE EUROPE acts as controller of your personal data and thus undertakes to act in accordance with (i) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as: “GDPR”), (ii) the Belgian Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data and (iii) all relevant regulation regarding the processing of personal data.

“Processing” of personal data means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

As PETCORE EUROPE processes your personal data, you qualify as a “data subject” within the meaning of article 4.1 of the GDPR.

As PETCORE EUROPE records images of all individuals entering the PETCORE EUROPE building through use of surveillance cameras, PETCORE EUROPE – in its capacity of data controller – hereby undertakes to comply at all times with the Belgian Act of 21 March 2007 regulating the installation and use of surveillance cameras (the “Camera Act”), as well as with the relevant Royal Decrees, namely: the Royal Decree of 8 May 2018 on the notification of the installation and use of surveillance cameras and on the register of image processing activities relating to such cameras, and the Royal Decree of 10 February 2008 establishing the manner in which camera surveillance must be indicated.

II.            Applicability

This privacy statement (hereinafter referred to as "Privacy Statement") is applicable  (i) to the activities on our website  https://petcore-europe.org/ (hereinafter referred to as the "Website"), (ii) to all (commercial) relations between PETCORE EUROPE and its members, customers, prospects and business partners and (iii) when visiting the building/office of PETCORE EUROPE.

III.          How do we obtain your personal data?

 

Your personal data may be obtained and collected by PETCORE EUROPE in the following ways:

- when you visit the Website

- when you inter into a collaboration with PETCORE EUROPE

- in case of incoming and outgoing correspondence with PETCORE EUROPE

- when you visit the office/building of PETCORE EUROPE

- when you create of a (demo-)account

- when you request an offer

- when you appeal on the services of PETCORE EUROPE, whether or not through the Website

- when we take pictures, videos and minutes during events

All personal data, collected by PETCORE EUROPE, are thus expressly and voluntarily provided by you.

Providing certain personal data is (sometimes) a requirement to be able to enjoy certain services (e.g. to gain access to certain parts of the Website, to subscribe to newsletters, to participate in certain activities and events). In this respect, it shall be indicated which data must be provided mandatory and which data is optional. 

IV.          For what purposes do we process your personal data?

PETCORE EUROPE can process your personal data exclusively in accordance with the purposes for which the personal data were provided to us. These purposes are described below:  

- Performance of the agreement with PETCORE EUROPE (incl. follow-up thereof)

-Sending communication of general or individual interest to prospects, customers or members (responding to informative/specific questions (whether or not received through the contact form on the Website), customer support etc.)

- Optimising the quality, management and content of the Website and for offering targeted advertisements on the Website if you have explicitly consented to this (commercial follow-up)

- Sending newsletters

- Creating analytical statistics (eg. when you have explicitly consented to analytical cookies while visiting our Website)

- Drawing up a quote

- Follow-up after a meeting

- Creation of an account (free or paying) and the confirmation thereof

- Providing support/assistance (e.g. in case of problems)

- Sending targeted marketing and advertising, updates and promotional offers based on your communication preferences and – where applicable – upon explicit consent

- Conducting customer satisfaction studies, surveys and other market research

- Registration of visitors at the office/building of PETCORE EUROPE

- Confirmation of the subscription of a webinar/seminar/event/etc.

- Issuing invoices and the collection thereof

- Legally required publications (Moniteur Belge, etc.)

- To combat money laundering and terrorist financing;

- To ensure the safety and health of our employees, staff and third parties who enter the premises of PETCORE EUROPE;

- To protect the property of PETCORE EUROPE.

PETCORE EUROPE also automatically collects anonymous information regarding your use of the Website if you consented to analytical cookies on our Website. As such, PETCORE EUROPE shall, for example, automatically log which sections of the Website and Platform you visit, which web browser you use, which website you visited when you obtained access to the Website. We cannot identify you through these data, but it allows PETCORE EUROPE to draw up statistics regarding the use of the Website.

V.            On what legal grounds do we process your personal data and how long does the processing last?

 

Personal data is collected and processed by PETCORE EUROPE on various legal grounds, as the case may be: 

1. Personal data is processed on the basis of consent:

In certain specific cases, we will process your personal data on the basis of your prior explicit consent. This applies, for example, in the following cases:

  • You have taken note of the notification (via icon) at the entrance that, upon entering the premises of PETCORE EUROPE, images are recorded via camera surveillance to ensure the safety and health of its employees, staff and third parties who enter the premises of PETCORE EUROPE and to protect the goods of PETCORE EUROPE, and you have consented to this specific processing activity by effectively accessing the relevant premises of PETCORE EUROPE
  • You have requested an offer

-      You have created an account on the Website (free or paid)

-      you have subscribed to receive newsletters from PETCORE EUROPE

-      you have consented  to receive targeted marketing and advertising, updates and promotional offers based on your communication preferences

-      you have subscribed/registered to a webinar/seminar/event/workshop etc.

-      you have consented to analytical cookies

-      you have consented to participate in customer satisfaction studies, surveys and other market research

The processing shall, in this case, be carried out until the consent is withdrawn (if applicable), or until the processing can, on reasonable grounds, be considered no longer necessary for the purpose(s) for which the personal data are processed.

2. Processing is necessary for the performance of the agreement with PETCORE EUROPE or in order to take steps at your request prior to entering into an agreement

The processing of personal data is carried out on the basis of its necessity for the performance of the agreement between PETCORE EUROPE and its customers, members, or other contractual parties. The personal data obtained by PETCORE EUROPE in this context will be retained for the duration of the collaboration. After the end of the collaboration, the personal data will be retained for the period during which either of the contracting parties can bring a legal claim against the other on the basis of the agreement concluded (i.e. a maximum of 10 years) or for the period during which PETCORE EUROPE is obliged to retain the personal data for accounting reasons (i.e. maximum of 7 years). However, PETCORE EUROPE undertakes to only retain those personal data that are necessary to fulfil the aforementioned storage purposes after the agreement has ended (principle of “data minimisation”) in accordance with Article 5.1, sub c) of the GDPR.

3. Processing is necessary for compliance with a legal obligation to which PETCORE EUROPE is subject

The processing of personal data also takes place in order to comply with legal obligations incumbent on PETCORE EUROPE, such as tax obligations (e.g. processing of personal data for invoicing purposes, annual customer listing, VAT returns,  obligations relating to the combat money laundering and terrorist financing, etc.

However, PETCORE EUROPE undertakes to store only those personal data that are necessary to fulfil the storage purposes under current legislation (principle of “data minimisation”) according to Article 5.1, sub c) of the General Data Protection Regulation).

4. Processing is necessary for the purposes of the legitimate interests pursued by PETCORE EUROPE or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject, which require protection of personal data

Personal data is also processed based on the legitimate interests of PETCORE EUROPE, such as announcing messages in the context of maintaining customer/member relations, expanding the customer/member base, expanding commercial contacts (e.g., responding to emails and online contact forms), satisfaction surveys, sending newsletters relating to the activities of PETCORE EUROPE etc.

To the extent that personal data is processed for the purpose of sending announcements or messages following a previous collaboration, this personal data will be retained for a maximum of five years after the end of the contractual relationship between PETCORE EUROPE and the customer. In any case, the (former) customer always has the right to unsubscribe free of charge if the customer no longer wish to receive messages or announcements from PETCORE EUROPE.

In addition, personal data is also processed on the basis of camera surveillance at the premises of PETCORE EUROPE to ensure the safety and health of its employees, staff, and third parties who enter the premises of PETCORE EUROPE and to protect the property of PETCORE EUROPE. The images from the cameras installed at PETCORE EUROPE are not stored for longer than one month, unless these images can contribute to proving a crime, damage, or nuisance, or to identifying a perpetrator, a disturber of public order, a witness, or a victim.

5. Processing is necessary in order to protect your vital interests or of another natural person

- Geographical location data

- Favourites and preferences specified by visitors on the Website;

- Browsing behaviour of visitors on the Website

- All personal data provided in the ‘free field’ when completing a contact form

- All personal data freely provided to PETCORE EUROPE (e.g. in light of correspondence with PETCORE EUROPE).

VII.         Whose personal data can we process?

PETCORE EUROPE can process personal data of, for example, the following natural persons:

  • (SPOCS) of members
  • SPOCS, directors of customers, prospects, contractual parties or other parties
  • Natural persons who contact PETCORE EUROPE via the online form on the Website
  • Natural persons who request an offer from PETCORE EUROPE
  • Natural persons who subscribe/register to and attend events, seminars, webinars
  • Natural persons who create a (demo)-account
  • Natural persons who enter the premises of PETCORE EUROPE
  • Natural persons who visit our Website

VIII.        Security of personal data by taking appropriate technical and organizational measures

PETCORE EUROPE is responsible for the processing of your personal data. PETCORE EUROPE therefore takes all appropriate technical and organizational measures to protect your personal data against accidental or unauthorized destruction, accidental loss, and any other unauthorized processing of personal data.

However, the security of your account will also partly depend on the confidentiality and complexity of your password. PETCORE EUROPE will never ask for your password, meaning that you will never be required to communicate it personally. If you have nonetheless communicated your password to a third party – for example because this third party has indicated that it wishes to offer additional services - this third party shall have access to your account and your personal data via your password. In such cases, you are liable for the transactions which occur as a result of the use made of your account. PETCORE EUROPE therefore strongly advises you, if you observe that someone has accessed your account, to immediately change your password and contact us.

IX.           No unlawful disclosure  of personal data to third parties

PETCORE EUROPE shall not disclose your personal data to third parties without valid reason.

Such valid reason is a situation in which the disclosure of personal data is necessary in the context of performing the agreement and optimisation thereof (including but not limited to PETCORE EUROPE). In this respect, your personal data may be disclosed to payment providers, software providers, cloud partner, transport partners, external consultants and service providers, as appropriate.

Furthermore, PETCORE EUROPE will not disclose personal data obtained to third parties unless this is necessary for the performance of the following purposes:

-  Disclosure to the competent authorities (i) if PETCORE EUROPEis obliged to do so under the law or under legal or future legal proceedings and (ii) to safeguard and defend our rights

- If PETCORE EUROPE, or the majority of its assets, are taken over by a third party, in which case your personal data – which PETCORE EUROPE has collected – shall be one of the transferred assets

- The contact details of PETCORE EUROPE members to other PETCORE EUROPE members after prior consent

- To the participants of events after prior consent

PETCORE EUROPE has entered into a processing agreement with the aforementioned parties, which qualify as processors and whereas these processors provide adequate guarantees that the processing of your personal data complies with the requirements of the GDPR, national regulations and this Privacy Statement in order to protect your rights.

In all other cases, PETCORE EUROPE will not sell, hire out or pass on your personal data to third parties, except when it has obtained your permission to this end.

X.            Cross-boarder processing of personal data 

Any transfer of personal data outside the European Economic Area (EEA) to a recipient whose domicile or registered office is in a country which does not fall under the adequacy decision enacted by the European Commission, shall be governed by the provisions of a data transfer agreement, which shall contain (i) the standard contractual clauses, as referred to in the 'European Commission decision of 4 June 2021 (Commission Implementing Decision (EU) 2021/914 ), or (ii) any other mechanism pursuant to Chapter V of the GDPR, or pursuant to any other regulations pertaining to the processing of personal data.

In light of the processing of your personal data, you enjoy the following privacy rights:

- Right of access to your personal data

- Right to rectification, completion or update of your personal data

- Right to delete your personal data ('right to be forgotten'). (PETCORE EUROPE wishes to Section out that in this context certain services will no longer be accessible and/or can no longer be provided if you delete resp. request deletion of certain required personal data)

- Right to limit the processing of your personal data

- Right to transferability of your personal data

- Right to object to/oppose the processing of your personal data

This enables PETCORE EUROPE to verify that the request is being mad by the person who is entitled to do so and to prevent the data from being unlawfully disclosed to third parties.

In principle, you can exercise these rights free of charge via the above-mentioned contact channels. In addition, you can always, via your personal account, update, modify and/or verify your personal data, which you were required to submit when creating your account.

If you no longer wish to receive newsletters or information about the services, products or goods of PETCORE EUROPE, you can unsubscribe at any time by clicking the "unsubscribe" button underneath each of PETCORE EUROPE’s impersonal emails or by replying “unsubscribe”.

You also have the right to access the images taken of you by the relevant surveillance camera at the premises of PETCORE EUROPE. However, the request for access must contain sufficiently detailed information to enable the relevant images to be located precisely. PETCORE EUROPE may refuse the request to copy the images in question in order to safeguard the rights and freedoms of other persons appearing in the images or to safeguard public safety or the prevention, the investigation, detection, and prosecution of criminal offenses, or the execution of penalties, including the protection against and prevention of dangers to public safety and the prevention of such dangers.

PETCORE EUROPE will comply with these rights to the extent possible in light of the performance of the agreement and/or its legal obligations.
